Terms & Conditions
- All service work rendered by the company shall be warrantied for a period of 90 days by the company. Manufacturer warranties on parts may apply beyond 90 days. All warranties provided by the company are void if heating or cooling systems are worked on by anyone not in the employ of the company. Warranty does not apply to any failure as a result of events beyond company control including but not limited to: tampering, flood, fire, electrical problems, failure of other system components which results in failure of another, and any other acts of God.
- This contract is solely an agreement between the company and the owner of the property to be serviced, and all agreement between the parties as the responsibility of the company and the value received by the customer is contained herein. Customer acknowledges that this service agreement in no way holds liable the company for any damages that may result from a failed heating or cooling system or any of its components.
- This agreement will be automatically renewed monthly or annually depending on how payment is chosen to be made upon initial enrollment. Monthly payments will be charged on the first (1st) of each month and annual payments will be charged on the first (1st) of the month, 12 months following the preceding payment.
- Service agreement may be terminated by the company at any time at the company’s sole discretion, and may be terminated by the customer at any time in writing only by emailing info@brothersmechllc.com. Contracts are non-refundable if terminated by the customer. If terminated by the company, a pro-rated refund will be provided if applicable. If contract is terminated by the customer prior to the 12-months following the last performed annual maintenance by the company, an early termination fee of $100 shall be applied and charged on the day of the termination.
- This agreement is non-transferable without the expressed permission of the company.
- Any cost of repair or maintenance required as result of vandalism, misuse, acts of war, terrorism, riots, acts of God (including lightning or casualty, such as fire or flood) is excluded. Any consequential damages as a result of maintenance or repair, or the necessity thereof including, but not limited to, damage due to overflow of water, mildew, fire, freezing of pipes, shall be excluded from this agreement and shall not be the responsibility of contractor unless due to contractor negligence or witful acts of omission.
After-hours service under this agreement shall be available 7 days a week, 24 hours a day for the heating system only between October 1 and April 30. After-hours emergency service for all systems shall be available between the hours of 9:00 am and 5:00 pm Fridays, Saturdays, and Sundays between May 1 and September 30.
